A2P SMS Terms of Service

These SMS Terms of Service ("SMS Terms") govern the use of text messaging services provided by  Sir Walleye Charters, LLC ("Sir Walleye Charters," "we," "us," or "our"). By opting in to receive SMS messages from us, you agree to these SMS Terms and our Privacy Policy.


1. Program Description

Sir Walleye Charters, LLC provides SMS communications to customers who opt in. These messages may include:

Charter booking confirmations

Trip reminders and updates

Customer support communications

Service notifications

Review requests

Promotional or marketing offers (if separately consented)


2. Opt-In Consent

By providing your mobile phone number and opting in through our website, booking forms, paper forms, or other consent methods, you expressly consent to receive recurring SMS messages from Sir Walleye Charters, LLC.

Consent is not a condition of purchase.


3. Opt-In Method and Consent

Customers opt in to receive SMS messages from Sir Walleye Charters, LLC by providing their mobile phone number and giving explicit consent through one or more of the following methods:

Website Forms:
Customers provide their phone number through booking forms, contact forms, or other website forms located on the Sir Walleye Charters website and affirm consent by checking an opt-in checkbox and submitting the form.

Direct Request:
Customers may opt in by requesting information, booking a charter, or communicating directly with Sir Walleye Charters, LLC and providing their mobile number with consent to receive SMS communications.

Verbal or Written Consent:
Customers may provide their phone number verbally in person or over the phone, or in writing, and consent to receive SMS messages related to their charter service.



4. Message Frequency

Message frequency varies depending on your interactions with us, but you can expect  up to 4 messages per month. Frequency may vary based on bookings, customer service inquiries, and promotions.


5. Message and Data Rates

Message and data rates may apply. Charges depend on your wireless carrier and service plan. Sir Walleye Charters, LLC is not responsible for any messaging charges incurred.


6. Opt-Out Instructions

You may opt out at any time.

To stop receiving SMS messages, reply:

After you send STOP, you will receive a confirmation message and will no longer receive SMS messages from us unless you opt in again.

SMS services are available on participating wireless carriers. Delivery is not guaranteed and may be subject to carrier availability.


10. Eligibility

You must be at least 18 years old or have permission from a parent or guardian to participate in our SMS program.


11. Changes to Terms

Sir Walleye Charters, LLC reserves the right to modify these SMS Terms at any time. Changes will be effective immediately upon posting.

Sir Walleye Charters, LLC uses SMS messaging to communicate with customers who have voluntarily opted in to receive text messages. These messages are strictly related to the services requested by the customer and the operation of our fishing charter business.

SMS communications may include:

Booking confirmations

Trip reminders and scheduling updates

Weather-related notifications

Customer support and responses to customer inquiries

Follow-up messages related to scheduled charters

Requests for customer feedback or reviews

Customers opt in to receive SMS messages by:

Submitting their phone number through our website booking forms

Completing a contact form

Providing their phone number verbally or in writing and consenting to receive SMS messages

All SMS messages clearly identify  Sir Walleye Charters, LLC as the sender.

By opting into SMS communications, you acknowledge that you have read, understood, and agree to these Terms of Service.


15. Carrier Liability Disclaimer – SMS Messaging

Sir Walleye Charters, LLC is not responsible for any delays in the receipt of SMS messages. Delivery of SMS messages is subject to effective transmission from your wireless service provider and is outside the control of  Sir Walleye Charters, LLC.

Carriers are not liable for delayed or undelivered messages.

Message and data rates may apply depending on the customer’s wireless carrier and mobile plan.

Wireless carriers are not responsible for the content of messages sent or received through  Sir Walleye Charters, LLCSMS services.

By opting in to receive SMS messages from  Sir Walleye Charters, LLC, you acknowledge and agree that message delivery is not guaranteed and that  Sir Walleye Charters, LLC and participating wireless carriers are not liable for delayed or failed message delivery.



16. Cancellation & Refund Policy:

Deposits: are non-refundable when a day is considered unsafe for chartered fishing.  Our clients may pick another date within the same season calendar to reschedule.

Last Minute: Cancellations forfeit the full amount of the deposit or may choose another available date within the current calendar year 


Weather/Mechanical: Captains reserve the right to cancel due to unsafe conditions,  offering to reschedule 

Liability Waiver (Assumption of Risk): Participants agree that fishing involves inherent risks (accidents, injury) and release the captain, crew, and company from liability.


Payment Terms: Deposits are due upon receipt to hold your date unless other arrangements have been made with your captain in writing Balances are  due at the conclusion for your trip the day of. 3.8% processing fee will be added for balances due paid with card.


17. Safety & Conduct Rules:

Prohibited Items: No illegal substances, recreational or medical marijuana, THC containing vapes, weapons, or glass bottles, hard liquor. Violations of the prohibited items will lead to termination of the trip without refund and balance is due in full at arrival of the dock.

Behavior: Disruptive or unsafe behavior can lead to termination of the trip without refund and balance due in full at the dock.

Children: PFDs (Personal Flotation Devices) are mandatory for children.

Alcohol/Food:  Alcohol is restricted to beer in cans only consumed in moderation determined by your Captain.

Fishing Licenses & Regulations: Customers are  responsible for acquiring necessary state/local fishing licenses 


Fish Catch Disclaimer: No guarantee of catching fish, and limits are set by state/federal regulations. 

It is highly recommended to read local state fishing laws and regulations.  Clients are not entitled to the captain and or first mates daily bag limits. Clients must obey all state fishing regulations. Fish and Game violations committed will result in termination of your trip with balance due in full. For the utmost respect for the Lake Erie fishery; clients are not permitted to “sort” legal size keeper walleyes. Our charters are 7 hours or limit of target species.
